How to file a DMCA takedown notice.

Last updated

MagicActors respects intellectual property rights and complies with the U.S. Digital Millennium Copyright Act (DMCA) and equivalent laws elsewhere. If you believe your copyrighted work has been used through the Service in a way that constitutes infringement, you can submit a takedown notice as described below.

1. Designated agent

Send DMCA notices to dmca@magicactors.com. The designated agent on file is reachable at that address.

2. What a complete notice contains

To be effective under 17 U.S.C. § 512(c)(3), your notice must include:

  • A physical or electronic signature of the copyright owner or an authorized agent.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing — include a URL or a render id from MagicActors where possible.
  • Your contact information: name, address, telephone, email.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

3. Counter-notice

If material you posted has been removed or disabled in response to a DMCA notice, you may submit a counter-notice to the same address. A counter-notice must include the elements required by 17 U.S.C. § 512(g)(3), including your consent to U.S. federal-court jurisdiction.

4. Repeat infringers

We terminate accounts of users who are determined to be repeat infringers under the DMCA.

5. False claims

Knowingly making a material misrepresentation in a DMCA notice or counter-notice can result in liability for damages. Consult a lawyer before filing if you are unsure whether the use is infringing.
